The United States Citizenship and Immigration Services (USCIS) has received a sufficient number of petitions to fulfil the established quota of 65,000 H-1B visa regular cap and the 20,000 H-1B visa U.S. advanced degree or master’s cap for the fiscal year 2024. Contrary to the expectations of certain industry and legal professionals, there will not be an additional or third round of selections.
Over the next few days, the USCIS will send non-selection notices to registrants through their online accounts. Registrations that were appropriately filed but were not chosen in the lottery will be reflected in the online portal with the message: “Not Selected: Not eligible to file an H-1B cap petition based on this Registration.”
The USCIS will continue to accept and process petitions for CAP exempt employers and beneficiaries that are CAP exempt because they were counted in a prior, qualifying fiscal year. The USCIS will also continue to accept and process petitions to:
• Extend the amount of time a current H-1B worker may remain in the United States;
• Change the terms of employment for current H-1B workers;
• Allow current H-1B workers to change employers; and
• Allow current H-1B workers to work concurrently in additional H-1B positions.
