Overcoming the Challenges of a Prolonged Absence: Facilitating Re-entry for a U.S. Green Card Holder

Nature of the Problem:

Assistance was provided to the mother of a U.S. citizen to facilitate her re-entry into the U.S. on her green card after an extended stay abroad of more than 6 years. This involved addressing potential issues related to her prolonged absence and ensuring compliance with U.S. immigration laws for lawful permanent residents.

Immigration Issue:

The applicant initially lived in the U.S. with her daughter and her family as a lawful permanent resident based on her green card. In 2016, she traveled to India to address personal matters, intending to return to the U.S. shortly. However, managing her property in India proved to be a complex and time-consuming process that required her direct involvement. Unfortunately, several factors prolonged her stay, including significant challenges in finalizing the property sale, her declining cognitive health, the COVID-19 pandemic, and her daughter’s family situation, all of which prevented her from returning to the U.S. as originally planned.

LawQuest’s Solution:

Since the applicant’s green card remained valid, the LawQuest team developed a strategy to facilitate her re-entry into the U.S. by addressing the situation at the Port of Entry. LawQuest drafted a comprehensive letter detailing the applicant’s circumstances and the legal provisions allowing her to return to the U.S. as a lawful permanent resident, despite her extended stay abroad. Given the applicant’s age and anxiety, we recommended that her U.S. citizen daughter travel to India and accompany her mother back to the U.S. Poorvi thoroughly prepared both the mother and daughter for the expected in-depth questioning at the Port of Entry, as well as the secondary inspection process they were likely to face.

Positive Outcome:

The mother successfully re-entered the U.S. with her daughter, despite enduring two long hours of questioning at the Port of Entry. She was able to explain her situation and medical condition to the U.S. officers, who, after considering her age and health, allowed her to enter the U.S. on her green card.
