L-1 and L-2 Visas

The L-1 visa category is designed for multinational companies to transfer qualified employees between its affiliated offices. This visa is divided into two subcategories: L-1A: For executives or managers and L-1B: For specialized knowledge workers.

The L-2 visa is for spouses and unmarried children under the age of 21 of L-1 visa holders. It allows dependents to accompany the primary L-1 visa holder to the United States.

For How long can I stay in the US on an L-1 Visa?

The duration of an L-1 visa depends on whether you qualify for an L-1A or L-1B classification. L-1A visa holders, typically executives or managers, can stay in the U.S. for up to seven years, including the initial three-year grant and two extensions. L-1B visa holders, those with specialized knowledge, are generally granted a maximum of five years, including the initial three-year stay and one extension. It’s essential to note that these are maximum durations, and actual stays may vary based on individual circumstances and USCIS approval.

Can I extend my L-1 visa stay beyond the initial period?

Both L-1A and L-1B visa holders can apply for extensions. However, there are limitations. L-1A visa holders can stay in the U.S. for a maximum of seven years, while L-1B visa holders can stay for a maximum of five years, including initial and extension periods. To extend your stay, you must file a new petition with USCIS before your current visa expires.

Can I change jobs while on an L-1 visa?

Changing jobs while on an L-1 visa can be complex. It generally requires obtaining a new L-1 visa with the new employer. Consulting with an immigration attorney is recommended.

The duration of an L-2 visa is tied to the validity of the primary L-1 visa holder’s status. If the L-1 visa is extended, the L-2 visa can also be extended accordingly.

Can I adjust my status on a L-2 visa to permanent resident?

Yes, L-2 visa holders can apply for a green card. However, this is contingent upon the primary L-1 visa holder obtaining employment-based permanent residency. Once the L-1 holder secures a green card, the L-2 dependent can file for adjustment of status to become a permanent resident.
